Privacy Policy

With this privacy policy, I inform you which personal data I process (i) when you visit my website, (ii) when you contact me and (iii) when I am mandated by you.

Personal data is any information relating to an identified or identifiable natural person ("data subject"). This includes, for example, the name, address or e-mail address of a person.

1. Data processing when you visit the website

When you visit this website, your IP address is collected, recorded and stored. I do not process any personal data, but only technical data such as the name of your internet service provider, the website you visited before accessing my website, and the pages you visit on my website. My website uses cookies. For more information, please refer to the cookie policy.

Purpose of data processing: Your information will be processed in order to compile usage statistics, to carry out an analysis of my website, to detect, investigate and prevent attacks on it and to make the website more user-friendly.

2. Data processing when sending an enquiry

If you contact me by e-mail, telephone or via the contact form, I will process the personal data that you provide to me. If you contact me by e-mail, I will process your name, e-mail address and the content of the message, including any attachments. The unsolicited transmission of personal data is deemed as explicit consent that I may process your data for the processing and settlement of your matter.

Purpose of this data processing: Your data will be stored and processed by me for the purpose of processing your request.
 
3. Data processing when you mandate me

In the event of a contractual relationship between you and me, I process the personal data that is necessary for the performance of my legal services, or that you have voluntarily provided.

Purpose of this data processing: Fulfilment of your order. In addition, the processing is carried out for the necessary assertion, exercise or defence of legal claims.

4. Legal basis for data processing

The legal basis for data processing is the following provisions of the General Data Protection Regulation ("GDPR"): Article 6 (1) (a) (consent), Article 6 (1) (b) (necessary for the performance of a contract), Article 6 (1) (c) (fulfilment of a legal obligation to which we are subject), Article 6 (1) (f) (overriding legitimate interest, which consists in achieving the above-mentioned purposes).

5. Transfer of your personal data

In order to fulfil your order, it may be necessary to forward your data to third parties (e.g. opposing party, substitutes, insurance companies, external service providers, etc.), courts or authorities. Your data will be forwarded exclusively on the basis of the GDPR, in particular for the fulfilment of your order, or on the basis of your prior consent.

Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not correspond to that of Austria. Subject to explicit consent or contractual necessity, I process or have the data processed only in third countries with a recognized level of data protection or on the basis of special guarantees, such as contractual obligations through so-called standard contractual clauses of the EU Commission in accordance with Articles 44-49 GDPR.

6. Data security

I take the necessary technical and organizational steps to protect your personal data from unauthorized, unlawful or accidental access by unauthorized persons, data manipulation, loss or destruction. The security measures are continuously improved in line with technological developments.

7. Duration of storage of your data

I will only store your data for as long as it is needed to fulfil the above-mentioned processing purposes, due to statutory retention periods or to defend against any liability claims.

8. Your rights

Under certain conditions, you have the following rights to the processing of your personal data: (i) right of access, (ii) right to rectification or (iii) deletion of your personal data if it is incorrect or processed contrary to the provisions of data protection law, (iv) right to restriction, (v) right to data portability, (vi) right to object, (vii) right to withdraw consent given. If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been violated, you also have the (viii) right to complain to the Austrian Data Protection Authority.

You have the right to obtain confirmation as to whether I am processing personal data concerning you. To do so, please email your request for information to office@gutbrunner.law and include a copy of an official photo ID as proof of your identity.

I am legally obliged to correct or delete incorrect or unlawfully processed data as soon as I become aware of the inaccuracy of data or the inadmissibility of its processing. If you believe that your personal data is being processed incorrectly or contrary to the applicable data protection regulations, please also send your reasoned written request by e-mail to office@gutbrunner.law.

You can object to the use of your data for the aforementioned purposes at any time with effect for the future and revoke previously given consent with effect for the future. You have the right to object at any time to the processing of personal data concerning you for the purpose of direct marketing, which I carry out on the basis of an overriding legitimate interest. You have the right to request the restriction of the processing of your personal data if one of the legal grounds for restriction applies. Please send your request by e-mail to office@gutbrunner.law.

You have the right to receive your personal data, which I process automatically on the basis of your consent or on the basis of a contract with you, in a structured, commonly used and machine-readable format. You can also transmit this data to a third party to whom the personal data has been provided. In addition, you have the right to have me transmit this data directly to a third party disclosed by you, as far as technically possible. Please send your request by e-mail to office@gutbrunner.law.

For further information on the type, scope and purpose of the data collected, please refer to the privacy policy of the respective operator. By clicking on an embedded button, you will be redirected to the page operated by me on the respective social media platform. The company profile is then automatically called up and your data, especially data from the server log files, is transmitted to the respective network. I have no direct control over cookies that are set by the operators of the respective social media platform after clicking on the corresponding button, nor over the scope and content of the data that is transmitted to them.
